Our firm is looking for a passionate, intelligent, and hard-working Appellate Lawyer Attorney with 5+ years of appeals experience to work for an appeal at the Law Office of Parag L. Amin, P.C. (“LawPLA”). For now, the job is entirely remote and is for a single appeal.
The job involves handling the opposition of an appeal for an attorney’s fees award where the Court denied the other side’s attorney’s fees motion based on the following clause in the applicable contract:
All parties shall initially share the cost of arbitration, but the prevailing party or parties may be awarded attorney fees, costs, and other expenses of arbitration. All arbitration decisions shall be final, binding, and conclusive on all the parties to arbitration, and legal judgment may be entered based upon such decision in accordance with applicable law in any court having jurisdiction to do so.
The Court denied the motion based on the argument that the clause only allows the parties to be awarded attorney’s fees for arbitration and not litigation. There was nothing in the contract that authorized the court to award attorney’s fees. The Court agreed. The other side is now appealing that order.
Please note that this position will be paid as it involves a single project for now so you must have your own malpractice insurance and be in good standing with the California State Bar with no disciplinary record.
